1 Introduction

1.1

By using/visiting the Community of Sweden.com, VisitSweden’s website www.VisitSweden.com and any sub-sites hereof, published and maintained by VisitSweden, or its subsidiaries (the “Website”) you manifest your approval to both these terms and conditions below (the “User terms” found at communityofsweden.com/Pages/Common/terms.aspx) and privacy policy (the “Privacy Policy” found at communityofsweden.com/Pages/Common/Privacy.aspx). If you are not accepting these terms please do not use the Website.

These User terms apply to all users of the Website, including users who contribute with pictures, information, written texts, video content and/or other materials.

The Website is provided by the company V.S. VisitSweden AB, organisation number 556500-7621, BOX 3030, 103 61 STOCKHOLM, (“VisitSweden”).

1.4

The Website may contain links to third party websites that are not owned or controlled by VisitSweden. By using the Website, you expressly relieve VisitSweden from any and all liability arising from your use of such third-party website. VisitSweden takes no responsibility for the content of such third party websites. When leaving the Website VisitSweden therefore encourage you to read the terms and conditions and privacy policy of any other website(s) that you may visit.

2 Access to the website

2.1

VisitSweden hereby grants you permission to use the Website as set forth in this User terms, provided:
  • that your use of the Website as permitted is solely for your personal, non-commercial use,
  • that you will not distribute or copy any part of the Website in any medium without VisitSweden's prior written authorization,
  • that you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose,
    • and
  • that you will comply with the terms and conditions of these User terms as well as the Privacy Policy.

2.2

In order to access some features of the Website, you will have to create a User Account. You may never ever use another person's user account without permission.

2.3

When creating your user account, you must provide VisitSweden with complete and accurate information.

2.4

You are solely responsible for the activity that occurs on your user account, and you must keep your User Account password secure.

2.5

You should change your User Account password on a regular basis.

2.6

You must notify the staff at VisitSweden immediately of any breach of security or unauthorized use of your User Account. Although the staff at VisitSweden will not be liable for your losses caused by any unauthorized use of your User Account, you may be liable for the losses of VisitSweden or others due to such unauthorized User Account use.

2.7

You agree not to use or launch any automated system (including without limitation "robots", "spiders" and "offline readers" etc.) that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a convention web browser.

2.8

Notwithstanding section 2.6, VisitSweden grants the operators of public search engines the permission to use spiders to copy materials from the website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. VisitSweden reserves the right to revoke these exceptions either generally or in specific cases.

2.9

You agree not to collect or harvest any personally identifiable information, including user account names, from the Website, nor to use the communication systems provided by the Website for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website.

3 Contributions

3.1

The Website permits the submission of pictures, video content, written texts and other materials submitted by you and other users ("User Submissions") and the hosting, sharing, and publishing of such User Submissions.

3.2

By using the Website you understand that whether or not such User Submissions are published, VisitSweden does not guarantee any confidentiality with respect to any submissions.

3.3

You are solely responsible for your own User Submissions and all the consequences of posting/publishing them. In connection with User Submissions, you confirm, signify, and warrant:
  • that you own or have the necessary licenses, rights, consents, and permissions to use and authorize VisitSweden to use every and all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these User terms.
  • that you have the written consent, release, and permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such person to enable inclusion and use of the User Submissions in the manner contemplated by the website and these User terms.

3.4

By submitting the User Submissions to VisitSweden, you grant:
  • VisitSweden an eternal, worldwide, non-exclusive, royalty-free, perpetual, sublicense able and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Website and VisitSweden's (and its successor's) business, and any other technology or media available today as well as in the future, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels.
  • each user of the Website a non-exclusive license to access your User Submissions through the Website, and to display and perform such User Submissions as permitted through the functionality of the Website and under these User terms. The foregoing license granted by you terminates once you remove or delete a User Submission from the Website.

3.5

In connection with User Submissions, you further agree that you will not:
  • Submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant VisitSweden all of the license rights granted herein.
  • Submit material that is unlawful, obscene, defamatory, libellous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law, or is otherwise inappropriate.
  • Publish falsehoods or misrepresentations that could damage VisitSweden or any third party.
  • Post advertisements or solicitations of business.
  • Impersonate another person.

3.6

VisitSweden does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and VisitSweden expressly disclaims any and all liability in connection with User Submissions.

3.7

VisitSweden does not permit copyright infringing activities and infringement of intellectual property rights on the Website.

3.8

VisitSweden will remove all User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights.

3.9

VisitSweden reserves the right to remove User Submissions without prior notice.

3.10

VisitSweden will terminate a user's access to the Website, if they are determined to be a repeat infringer. VisitSweden also reserves the right to decide whether a User Submission is appropriate and complies with these User terms for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. VisitSweden may remove such User Submissions and/or terminate a user's access for uploading such material in violation of these User terms at any time, without prior notice and at its sole discretion.

3.11

VisitSweden permits you to link to materials on the website for personal, non-commercial, purposes only, provided that you include a prominent link back to the Website on the page. VisitSweden reserves the right to discontinue any aspect of the Website at any time.

Intellectual property rights

4.1

The content on the Website, except all User Submissions, including without limitation, the text, software, scripts, flash programs, graphics, photos, sounds, music, videos, interactive features and the like ("Content") as well as trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to VisitSweden, subject to copyright and other intellectual property rights under Swedish material law and international conventions.

4.2

All Content and all Marks on the Website is provided to you as is for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of each respective owner.

4.3

VisitSweden reserves all rights not expressly granted in and to the Website and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of Contributions of third parties obtained through the Website for any commercial purposes.

5 Warranty Disclaimer and Limitation of Liability

5.1

You agree that your use of the Website shall be at your own risk. To the fullest extent permitted by law, VisitSweden, disclaim all warranties, express or implied, in connection with the website and your use thereof. VisitSweden makes no warranties or representations about the accuracy or completeness of the content of the Website or the content of any websites linked to the Website and assumes no liability or responsibility and shall in no event be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages for any:
  • errors, mistakes, or inaccuracies of content,
  • personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website,
  • any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein,
  • any interruption or cessation of transmission to or from our website,
  • any bugs, viruses, trojan horses, or the like which may be transmitted to or through our website by any third party, and/or
  • any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Website. VisitSweden does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the Website or any hyperlinked website or featured in any banner or other advertising. Nor will VisitSweden be a party to, or in any way be responsible for, monitoring any transaction between you and third-party providers of products or services.

5.2

You specifically acknowledge that VisitSweden shall not be liable for User Submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

5.3

The Website is controlled and offered by VisitSweden from its facilities in Sweden. VisitSweden makes no representations that the Website is appropriate or available for use in other locations. Those who access or use the Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

6 Indemnity

6.1

You agree to defend, indemnify and hold VisitSweden harmless, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
  • your use of and access to the Website,
  • your violation of any term of these User terms,
  • your violation of any third party right, including without limitation any copyright, property, or privacy right,
    • and/or
  • any claim that one of your User Submissions caused damage to a third party.
This defence and indemnification obligation will survive these User terms and your use of the Website.

7 Assignment

7.1

These User terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by VisitSweden without restriction and without notifying you.

8 Changes of the User terms

8.1

VisitSweden may at any time and without notice change these User terms, e.g. to keep it compliant with applicable law. Such changes of the User terms shall be deemed binding as soon as they are published on the Website. You should therefore read the User terms each time you intend to use or visit the Website.

9 General

You agree that:
  • the Website shall be deemed solely based in Sweden.
  • These User terms shall be governed by the laws of Sweden, without respect to its conflict of laws principles.
  • Any claim or dispute between you and VisitSweden that arises in whole or in part from the Website shall be decided exclusively by a court of competent jurisdiction located in Stockholm, Sweden.
  • These User terms, together with the Privacy Policy and any other legal notices published by VisitSweden on the website, shall constitute the entire agreement between you and VisitSweden concerning the Website.
  • If any provision of these User terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these User terms, which shall remain in full force and effect.
  • No waiver of any term of this these User terms shall be deemed a further or continuing waiver of such term or any other term, and VisitSweden's failure to assert any right or provision under these User terms shall not constitute a waiver of such right or provision.
  • Your use of the Website following any amendment of these User terms will signify your assent to and acceptance of its revised terms.
  • Any claim arising out of or related to the Website must be communicated within one (1) year after the cause of the claim occurred or the claim will be void.
